Welcome to PezGato Amazing Adventures. By making a reservation, purchasing a ticket, or participating in any tour, activity, transportation service, or charter operated by PezGato, you acknowledge and agree to the following Terms & Conditions.
1. Reservations and Payments
- All reservations are subject to availability and are confirmed only after payment has been successfully processed.
- PezGato accepts major credit cards and other payment methods displayed during the booking process.
- Prices are listed in U.S. Dollars (USD) unless otherwise indicated and are subject to change without prior notice.
2. Cancellation and Refund Policy
Shared Tours and Activities
- Reservations may be cancelled or modified up to 24 hours before the scheduled activity for a full refund.
- Cancellations made less than 24 hours before the scheduled activity are non-refundable.
- Failure to arrive at the designated meeting point on time will be considered a no-show and no refund will be provided.
- Reservation date changes requested within 24 hours of the activity may be subject to a 25% change fee and availability.
Private Charters and Group Reservations
Cancellation Policies
- There is a 10% fee for cancellations made over 61 to 90 days before date reserved.
- There is a 25% fee for cancellations made from 31 to 60 days before date reserved.
- There is a 50% fee for cancellations made from 15 to 30 days before date reserved.
- There is a 100% fee for cancellations made under 15 days before date reserved.
Changes to the number of people
- Up to 72 hours before your charter, the final number (guarantee) of people can be reduced, as long as it is not less than the minimum number for the boat.
- Up to 12 hours before your charter, the number of people can be increased. Subject to availability.
Weather and Port Closures
If the Port Authority officially closes the port or PezGato determines that operating conditions are unsafe, guests may choose between:
- Rescheduling the activity for another available date; or
- Receiving a full refund.
Weather conditions that do not result in an official port closure do not automatically qualify for refunds.
Refunds, when approved, may require 5–10 business days to appear on the original payment method.
3. Check-In Requirements
- Guests must arrive at least 30 minutes before departure unless otherwise indicated in their confirmation.
- PezGato reserves the right to deny boarding to late arrivals without refund.
- A valid government-issued photo identification may be required.
4. Transportation Services
- Transportation can be arranged at an additional cost and is subject to availability and operational schedules.
- Pickup times are already set based on the hotel and area where you are staying and may vary due to traffic, weather conditions, or other operational circumstances.
- Transportation must be confirmed at least 24 hours before the scheduled activity to guarantee the service.
- If you have booked transportation service, please be ready at the motor lobby 5 minutes before your scheduled pickup time. Your driver will be wearing khaki pants, a white polo shirt, and will be holding a Pez Gato sign. Drivers will wait for a maximum of 5 minutes after the scheduled pickup time at the designated meeting point.
- At the end of the tour, your driver will wait for you for up to 10 minutes.
- PezGato shall not be responsible for delays caused by circumstances beyond its control.
5. Participation Requirements
Guests must comply with all safety instructions provided by the captain, crew, guides, and staff.
PezGato reserves the right to deny participation to any guest who:
- Appears intoxicated or under the influence of drugs;
- Behaves in a dangerous or disruptive manner;
- Presents a medical condition that may endanger themselves or others.
Pregnant guests and individuals with certain medical conditions should consult their physician before participating in any activity.
6. Assumption of Risk
Participation in marine and outdoor activities involves inherent risks, including but not limited to:
- Slips, falls, and injuries;
- Exposure to weather conditions;
- Wildlife interactions;
- Equipment malfunction;
- Risks associated with ocean activities and transportation.
By participating, guests voluntarily assume all risks associated with the activity to the fullest extent permitted by law.
7. Liability Limitation
PezGato shall not be liable for:
- Loss, theft, or damage of personal belongings;
- Delays caused by weather, government authorities, mechanical issues, or force majeure events;
- Injuries resulting from failure to follow safety instructions.
The maximum liability of PezGato shall not exceed the amount paid by the guest for the affected service.
8. Photography and Marketing
Photographs and videos may be taken during activities.
By participating, guests grant PezGato permission to use photographs or video footage for promotional, marketing, and advertising purposes unless written notice is provided before the activity.
9. Force Majeure & 10. Governing Law
PezGato shall not be responsible for cancellations, delays, or service interruptions caused by events beyond its reasonable control, including:
- Hurricanes
- Tropical storms
- Natural disasters
- Epidemics or pandemics
- Government restrictions
- Labor disputes
- Mechanical failures
- Acts of God
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Mexico.
Any dispute arising from services provided by PezGato shall be submitted to the competent courts of Los Cabos, Baja California Sur, Mexico.
